  • Copyright Infringement Demand Letter from PicRight - is this serious?

    I got this email today demanding $750.

    I incorporated an activist's image into a school project.
    During my senior year, I was required to create a portfolio website showcasing my projects.

    I've now received three emails from a company asserting ownership of the image, demanding $750 for unauthorized use. The image is contained within a PDF. I'm reluctant to pay this amount and hesitate to respond, fearing that my response might be used against me. What course of action should I take? Can they escalate this further if I don't pay?

    The company claiming ownership of the picture is based in France.
    PicRight, the company contacting me, is located in Canada but is requesting payment to a Swiss bank account?
    I reside in Florida, United States.​

    VERY VERY unlikely they'll pursue anything over a school project that made no money.

      If the photo was not registered, they should only be able to come after you for actual damages.

      It's unlikely they will actually sue you over 1 photo that was not registered, because they're risking not being able to prove the damage amount in court. What was the photo anyways? Was it Michael Jackson's last moments or just some stock photo that's available for $5.
      It's 1 photo... and doesn't sound like you used it to make a ton of money.

      I wouldn't worry, BUT every situation is different so you want to consult a lawyer.​
